In view of the abuses against all of our comrades held as political prisoners and in view of the ELEVEN YEARS OF UNJUST IMPRISONMENT OF OUR INDIGENOUS ZAPOTEC BROTHERS FROM THE LOXICHA REGION, WE URGE YOU TO DEMONSTRATE ON September 25, 2007 (the 11th anniversary of the repression in Loxicha).

Compañeros and compañeras:

We wish to inform you that yesterday, September 20, 2007, the Oaxaca state government authorities made yet another dirty move against our compañero David Venegas “El Alebrije”.

Just a few days before, the federal authorities had responded to the petition for a protective writ for David against the pre-trial detention order on charges of SEDITION, CRIMINAL CONSPIRACY, and ARSON, granting him a protective writ for the second time. He is due to be released, given that the federal authorities recognized that there was no legal basis for any of the three charges against him. (en español)

Yesterday, however, the day he should have been released, the authorities of the Ulises Ruíz government issued a NEW PRE-TRIAL DETENTION ORDER ON RECONFIGURED CHARGES, which are:

ATTACKING A THOROUGHFARE, RESISTING ARREST, REBELLION, AGGRAVATED ASSAULT, AND CRIMES AGAINST PUBLIC OFFICIALS.

As a result, our compañero has not been released and is still unjustly held prisoner at Oaxaca’s central prison Santa Marìa Ixcotel, when he should have already been granted his unconditional freedom.

So great is the current government’s fear of freeing a rebellious young man that it has resorted to a whole series of political and judicial maneuvers and false arguments to keep him in prison. We remind you that:

Abuse Nº 1 David was arrested in April, 2007 on trumped up drug charges despite the fact that our comrade neither uses nor sells them.

Abuse Nº2 When David was just about to be released due to unfounded charges, a new pre-trial detention order was issued for the offenses of SEDITION, CRIMINAL CONSPIRACY, AND ARSON.

Abuse Nº3 Threats were sent against David and his family by the murderer Ulises Ruíz in May of 2007.

Abuse Nº4 When David obtained a protective writ in June against these charges, the Oaxaca state government authorities took the writ under consideration, thereby delaying his release even more.

Abuse Nº5 When the federal authorities declared that there were no constitutional grounds for the three charges and that David should be immediately released, the state authorities issued a new pre-trial detention order on the five previously mentioned charges.

In view of the abuses against all of our comrades held as political prisoners and in view of the ELEVEN YEARS OF UNJUST IMPRISONMENT OF OUR INDIGENOUS ZAPOTEC BROTHERS FROM THE LOXICHA REGION, WE URGE YOU TO DEMONSTRATE ON September 25, 2007 (the 11th anniversary of the repression in Loxicha).

IN THE CITY OF OAXACA, THERE WILL BE A MARCH AT 4:00 PM, STARTING FROM THE PASEO JUÀREZ “EL LLANO”.

NUEVAMENTE NIEGAN LIBERTAD PARA DAVID VENEGAS
“Alebrije”

Les informamos a que el dìa de ayer 20 de septiembre de 2007, las autoridades del gobierno del estado de Oaxaca hicieron una sucia jugada màs, a nuestro compañero David Venegas “El Alebrije”.

Dìas antes, por segunda ocasión, las autoridades federales en respuesta a la solicitud de amparo interpuesto en contra del auto de formal prisiòn para David por los delitos de SEDICIÓN, ASOCIACIÓN DELICTUOSA Y DAÑOS POR INCENDIO, le otorgan el amparo. Por lo cual se ordena la libertad para nuestro compañero, pues reconocieron las autoridades federales que ningùno de los 3 delitos de los cuales era acusado David estaban sustentados jurídicamente.

El dìa de ayer, cuando nuestro compañero debió ser puesto en libertad inmediata, las autoridades del Gobierno de Ulises Ruìz le dictaron un NUEVO AUTO DE FORMAL PRISIÒN POR RECONFIGURACIÒN DE DELITOS, ahora los delitos de los cuales acusan a nuestro compañero son:

ATAQUES A LAS VIAS GENERALES DE COMUNICACIÓN, RESISTENCIA DE PARTICULARES, REBELIÓN, ATAQUES PELIGROSOS Y DELITOS COMETIDOS CONTRA FUNCIONARIOS.

Por lo anterior nuestro compañero no ha sido liberado y actualmente se encuentra preso injustamente en la penitenciaría central de Oaxaca, Santa Marìa Ixcotel, cuando ya debería estar en libertad absoluta.

Tanto es el miedo del actual gobierno de tener en libertad a un joven rebelde, que no es la primera vez que utiliza mañas y argucias polìticas y jurìdicas para mantenerlo en prisiòn. Recordemos:

Abuso Nº 1 La detención de David (abril de 2007) supuestamente por posesión de drogas. Cuando nuestro compañero ni es distribuidor ni consumidor de las mismas.

Abuso Nº2 Cuando estaba pronta la salida de David por la inconsistencia de la acusación, le dictan otro auto de formal prisión por los nuevos delitos de SEDICIÓN, ASOCIACIÓN DELICTUOSA Y DAÑOS POR INCENDIO.

Abuso Nº3 Las amenazas del asesino Ulises Ruìz enviadas en el mes de Mayo de 2007 a David y su familia.

Abuso Nº4 Cuando en el mes de junio, David gana el amparo en contra de los delitos de que se le acusaba, las autoridades del Estado de Oaxaca someten a revisión dicha resolución y con ello retardan aùn màs la liberación de David.

Abuso Nº5 Cuando las autoridades federales recalcan que los 3 primeros delitos no son sustentados constitucionalmente y se debe poner en libertad a David, le dictan un Nuevo Auto de Formal Prisiòn por 5 delitos mencionados con anterioridad.

Ante todos estos abusos a los cuales son sometidos cada uno y una de nuestr@s compañer@s pres@s polìtic@s y ante los 11 AÑOS DE INJUSTO ENCARCELAMIENTO A NUESTROS HERMANOS PRESOS INDÌGENAS ZAPOTECOS DE LA REGIÒN LOXICHA, INVITAMOS A MOVILIZARCE EL DÌA 25 DE septiembre de 2007 (aniversario Nº11 de la represión en Loxicha).

EN OAXACA, ESE DÌA SE REALIZARÀ UNA MARCHA QUE SALDRÀ A LAS 4:00PM DEL PASEO JUÀREZ “EL LLANO”.

¡LAS REJAS NO CALLARÀN LA VERDAD!
