As the years go by, it’s all the more clear that the Mexican State and its repressive misgovernments, like that of Ulises Ruiz in Oaxaca, are still determined to label all those who struggle for equality and justice as criminals. The coercive, repressive mechanisms implemented by the political powers-that-be have many names and many facets.
In the country as a whole we count our political prisoners by the hundreds and witness constant political assassinations, forced disappearances, torture, military police harassment and abuse, and extra-official harassment by paramilitary groups. All three branches of government have played a role in legalizing this police state: the legislative branch legalizes the repression of social movements with its new reform of the penal code; the judicial branch protects criminals and grants them impunity, as in the case of the governor of the state of Puebla; and the executive branch devotes itself to protecting and administering the interests of the political and corporate class.
The people of Oaxaca have historically struggled against these misgovernments. The popular teachers’ movement that emerged a little more than a year ago is not a phenomenon that is isolated from history or from the national political scene. This movement couldn’t be explained without speaking of the people who gave their lives and liberty years before, who defied the powers-that-be and helped to build an important part of our righteous Oaxaca. Such is the case with our comrade Pedro Castillo Aragón, who has been kidnapped by the State since 2002 and is held captive in the Santa Maria Ixcotel Penitentiary. We use the word “kidnapped” because his offenses were totally fabricated with malice aforethought.
On June 23, 2002, our comrade Pedro Castillo Aragón, who was both advisor and student, was disappeared and rigorously interrogated with a number of torture techniques. Two days later he was accused of belonging to different guerrilla groups and charged with kidnapping, attempted homicide, resisting arrest, car theft, criminal conspiracy, and possession of arms. Due to the lack of proof of his guilt, we won a protective order on five of the charges, which reveals that the one remaining charge doesn’t hold water and irrefutably exposes their clumsy efforts to criminalize him.
During his interrogation, Pedro was questioned about his activity in different communities in the Sierra Sur, the Isthmus, and the Basin of the state of Oaxaca and was pressured to identify certain social leaders and professors in Section 22 of the National Education Workers Union, who the government says may have ties to armed groups.
During the same days, three people were arrested who didn’t know each other; nevertheless, they were charged as Pedro’s co-defendants. One of them, an ex-leader of the teachers’ union, was identified in police inquiries as the head of the supposed guerrillas; he was released as the result of political negotiation. Those who are still held prisoners along with Pedro are Isabel Almaraz Matías and Gonzalo López Cortés.
Pedro’s case is best seen in the framework of the intransigent criminalization of the social struggle, now continued by today’s rulers. The result of this is the permanent, bestial State terrorism that keeps wounds open in Oaxaca just as it does in Chiapas, San Salvador Atenco, Guerrero, and many other places where dignity has flourished, along with hope for a new life without poverty, but with freedom and justice.
In view of all this, we announce the beginning of mobilizations on January 14 in the city of Oaxaca, for the freedom of Pedro Castillo Aragón and all the political prisoners and prisoners of conscience in Oaxaca and in the country. We call on the movement as a whole and all the independent organizations to strengthen the struggle for the freedom of all our political prisoners as a major axis, as well as the struggle for justice for our dead, the live presentation of our disappeared people, and, above all, an end to the repression.

Conforme pasan los años queda más claro, que el Estado Mexicano y sus desgobiernos represores, como el de Ulises Ruiz en Oaxaca, siguen empeñados en llamar criminales a quienes luchamos por la igualdad y la justicia. Los mecanismos coercitivos y represivos a implementar desde el poder político tienen muchos nombres y muchas facetas.
En todo el país contamos por cientos a nuestr@s pres@s polític@s y son una constante los asesinatos políticos, las desapariciones forzadas, la tortura, el hostigamiento policíaco militar y el acoso extrajudicial de grupos paramilitares. Los tres poderes se han prestado para legalizar este estado policíaco, el poder legislativo legaliza la represión de los movimientos sociales con su nueva reforma al código penal, el judicial protege a los criminales y los mantiene impunes como es el caso del gobernador de Puebla y el poder ejecutivo se dedica a proteger y administrar los intereses de una clase política y empresarial.
El pueblo de Oaxaca históricamente ha luchado contra estos desgobiernos; el movimiento magisterial popular que surgió hace más de un año no es un hecho aislado, ni de la historia, ni del escenario político nacional. Este movimiento no se podría explicar sin gente que entregó su vida y su libertad años antes, que impugnó y ayudó a construir una parte importante de esta Oaxaca digna. Tal es el caso de nuestro compañero Pedro Castillo Aragón quien desde el 2002 se encuentra secuestrado por el Estado en el centro Penitenciario de Santa Maria Ixcotel, decimos secuestrado porque sus delitos fueron fabricados dolosamente en su totalidad.
El 23 de Junio del 2002 nuestro compañero asesor y estudiante Pedro Castillo Aragón fue desaparecido para ser rigurosamente interrogado bajo diversas técnicas de tortura. Dos días después se le acusa de pertenecer a diferentes grupos guerrilleros, se le imputan los delitos de secuestro, tentativa de homicidio, resistencia de particulares, robo de vehículo, asociación delictuosa y portación de arma de fuego. Ante la falta de elementos jurídicos que aprueben su culpabilidad, ganamos un amparo con lo cual se le dicto libertad por cinco delitos, con esto queda desconfigurada la acusación que por si sola es insostenible y se comprueba fehacientemente el burdo montaje con el que han intentado criminalizarlo.
Durante el interrogatorio Pedro era cuestionado sobre su actividad en diferentes comunidades de la Sierra Sur, el Istmo y la Cuenca del estado de Oaxaca y era presionado para señalar a ciertos líderes sociales y profesores de la sección 22 del Sindicato Nacional de Trabajadores de la Educación que según el gobierno, podían tener vínculos con grupos armados.
En esos mismos días fueron detenidas tres personas que no se conocían entre sí, pero que según las autoridades eran coacusados con Pedro, uno de ellos, ex-líder magisterial de la sección 22, fue señalado en diligencias judiciales como jefe de los presuntos guerrilleros y el cual recuperó su libertad meses después de una negociación política. Quienes continúan presos al igual que Pedro son Isabel Almaraz Matías y Gonzalo López Cortés.
El caso de Pedro se enmarca en la empecinada criminalización de la lucha social, de la que los actuales desgobiernos solo son continuadores. Resultado de esto es la permanente bestialidad del terrorismo de Estado que mantiene heridas abiertas tanto en Oaxaca como en Chiapas, tanto en San Salvador Atenco como en Guerrero y en muchas otras partes donde la dignidad ha florecido en tanto crece la esperanza por una vida nueva, sin pobreza, sin opresión, con libertad y con justicia.
Ante ello anunciamos el inicio de movilizaciones para este 14 de enero en la ciudad de Oaxaca, por la libertad de Pedro Castillo Aragón y por la libertad de tod@s l@s pres@s polític@s y de conciencia de Oaxaca y del País. Hacemos un llamado al movimiento en general y a todas las organizaciones independientes para qué fortalezcamos, como eje central, la lucha por la libertad de tod@s nuestr@s pres@s, la justicia para nuestr@s muert@s, la presentación con vida de l@s desaparcid@s y para detener la represión por encima de todo.
