November 29th, 2006 – Committee of Family and Friends of the Disappeared, Killed, and Imprisoned People of Oaxaca (COFADAPPO) writes: On November 25, 2006, the Federal Preventive Police (PFP) initiated a violent attack on demonstrators in the 7th peaceful megamarch in the historic center of the city of Oaxaca. The march began at 12:00 noon at San Bartolo Coyotepec and headed for the Zócalo, the city’s main plaza. The first contingents arrived at the area around the Zócalo at 3:00 p.m. PFP attacks consisting of firing teargas and projectiles at the demonstrators originated a violent confrontation between the PFP and APPO members that lasted until approximately 8:25 that night.

The streets of the Historic Center became a battlefield and a scene of brutal repression against Oaxaca’s peaceful popular movement. Witnesses say that the PFP not only used anti-riot tanks, clubs, shields, stun guns, and teargas grenade launchers, but also high-power arms and that they fired directly at the people of Oaxaca.
As of Monday, November 27, 2006, 141 people arrested over the weekend have been transferred from the prisons of Miahualtlán and Tlacolula, Oax., to the maximum security prison called the Federal Readaptation Center (CEFERESO) 4 at “El Rincón, Tepic, Nayarit. Prisoners include 34 women, 107 men––bricklayers, students, accountants, lawyers, carpenters, children, businessmen, workers, and farmers. The transfer was ordered by the Oaxaca state Department of Public Safety (SSP).
As a result of the transfer, prisoners are isolated from their family members, with whom it is difficult to maintain communication. The large majority are people with very few resources, and many are indigenous people. In view of the long distances involved, travel costs are high, and there are many complications in obtaining visiting permits at CEFERESO 4 in Tepic, Nayarit. It’s important to point out that the few family members who have come to visit the prisoners have been accompanied by lawyers who are needed to give them counsel, but that prison authorities have refused to allow these private defenders to enter. This constitutes a serious violation of their RIGHT TO AN ADEQUATE DEFENSE, guaranteed in our Constitution.
Yesterday, only three of the family members who have come to Nayarit have been allowed to visit prisoners. Based on their testimony, we can confirm signs of torture, such as fractured ribs and hematomas on different parts of the body. Some bear (recently performed) sutures. At Tlacolula and Miahuatlan medical attention was denied. We presume that the intention of the federal government in denying access to the other prisoners is to prevent us from obtaining evidence of their physical condition. Our impotence has led us to convoke national and international Human Rights organizations, social organizations, and the Indian peoples of the world and of Mexico to set up an encampment demanding the immediate liberation of the political prisoners of Oaxaca in the city of Tepic, Nayarit, with respect for their fundamental rights and freedom.
As of today, we are calling for three immediate national actions in defense of the prisoners of Oaxaca:
–painting the slogan “FREEDOM FOR APPO PRISONERS” on vehicles.
–hanging banners demanding their freedom in schools, universities, and public places.
–putting up posters outside the federal courts in each state that say “FREE OAXACA” (OAXACA LIBRE).
The aim of these peaceful actions is to call the attention of the people of Mexico and the world to the indiscriminate witchhunt of Oaxaca citizens.
At the same time that these actions are carried out, the COFADAPPO and non- governmental organizations are petitioning the federal government for:
-The immediate freedom of the 141 prisoners in Nayarit and the remaining prisoners in the state of Oaxaca.
-The presentation of disappeared people alive, an end to arrests, and the suspension of arrest warrants for social activists.
-An investigation conducted by the appropriate authorities into the facts surrounding the killings that have occurred since the beginning of the conflict and any negligence involved, with the purpose of determining who was responsible and trying and sentencing the guilty parties.
-The immediate ouster of the Oaxaca state governor Ulises Ruiz Ortiz, whose authoritarianism originated the conflict and whose refusal to step down is the cause of the violent, repressive solution to the conflict now being implemented.
-THE IMMEDIATE EXIT OF THE PFP FROM THE CITY AND STATE OF OAXACA
-The establishment of a joint commission in the federal Congress consisting of representatives and senators, which should be sent to investigate and take pertinent actions regarding the extremely serious situation of these 141 prisoners of conscience from the state of Oaxaca.

El día (25 de noviembre de 2006) la Policía Federal Preventiva inició una violenta agresión en contra de los manifestantes de la 7ª mega marcha pacifica en el centro histórico de la ciudad de Oaxaca. A las 12:00 horas empezó la 7ª megamarcha pacifica desde San Bartolo Coyotepec hacia el centro de la ciudad la cual empezó a llegar a los alrededores del Zócalo a las 15:00 horas. Las agresiones de los elementos de la PFP hacia los manifestantes arrojando gases lacrimógenos y proyectiles al contingente fueron el origen de un violento enfrentamiento entre la PFP y los integrantes de la APPO hasta aproximadamente las 20:45 horas.
Las calles del Centro Histórico fueron el reflejo de un violento campo de batalla y de una brutal represión hacia el movimiento popular pacifico de Oaxaca. Según testimonios además de usar tanquetas, toletes, escudos, picanas eléctricas, morteros lanzagranadas y gases lacrimógenos, los elementos de la PFP estaban armados con armas de alto poder y tiroteando directamente hacia la población de Oaxaca.
El lunes 27 de noviembre de 2006 han sido trasladados(as) desde los penales de Miahualtlán y Tlacolula, Oax., 141 detenidos de los cuales 34 mujeres y 107 hombres albañiles, estudiantes, contadores, abogados, carpinteros, niños, comerciantes, obreros y campesinos hacía el CEFERESO 4, El Rincón, Nayarit, penal de alta seguridad, en solicitud de la Secretaría de Seguridad Pública del estado de Oaxaca.
Este supuesto tiene como consecuencias el aislamiento de los(as) detenidos(as) y el difícil vinculo con sus familiares, los cuales son en gran mayoría personas de escasos recursos y muchos de ellos Indígenas, tomando en cuenta la distancia y los gastos de desplazamientos que esta situación conlleva, además de la complicación de los trámites de visitas al CEFFERESO numero 4 en Tepic Nayarit, es importante señalar que los pocos familiares que se han presentado para poder ver a los detenidos han ido acompañados de abogados para brindarles asesoria a estos, pero las autoridades del penal les han negado el acceso a los defensores particulares, esto violenta gravemente su derecho a LA ADECUADA DEFENSA , consagrado en nuestra Constitución.
El día de ayer solo pudieron tener acceso tres de los familiares que se encuentran acá en Nayarit, y por testimonio de ellos podemos constatar que presentan huellas de tortura, tales como fracturas de costillas y hematomas en diferentes partes del cuerpo, algunos tienen suturas (hasta ahora), la atención medica en Tlacolula y en Miahuatlan les fue negada, presuponemos que la intención del gobierno Federal en no permitir el acceso para con los demás, es solo por no evidenciar la condición física en que se encuentran, esta impotencia nos lleva ha CONVOCAR a las ORGANIZACIONES DE DERECHOS HUMANOS, nacionales e internacionales, así como a las ORGANIZACIONES SOCIALES, a los PUEBLOS INDIOS DEL MUNDO, a MËXICO EN GENERAL a instalar un campamento por la LIBERACION INMEDIATA DE LOS PRESOS POLITICOS DE OAXACA en la ciudad de TEPIC NAYARIT, MËXICO, por el respeto de sus derechos fundamentales y la libertad de ellos.
A partir de hoy hemos lanzamos tres acciones inmediatas para la defensa de los presos de Oaxaca a nivel Nacional:
en los vehículos Propios pintar la leyenda LEBERTAD A LOS PRESOS DE LA APPO.
colocar mantas en escuelas, universidades y lugares públicos en apoyo a su liberación.
colocar letreros a la salida de los JUZGADOS FEDERALES en cada estado que digan OAXACA LIBRE.
Estas Acciones Pacificas tienen por objeto el reclamo general del pueblo de México y el Mundo por la caceria indiscriminada a los Ciudadanos de Oaxaca.
Ante estas acciones la COFADAPPO y los organismos no gubernamentales participantes solicitamos al Gobierno Federal:
La Liberación Inmediata de los 141 Presos en NAYARIT y los demás en el Estado de Oaxaca.
La presentación con vida de los desaparecidos, el cese de las detenciones y la suspensión de las órdenes de aprehensiones en contra de los luchadores sociales.
Que las autoridades correspondientes investiguen los hechos de asesinatos desde el principio del conflicto y las negligencias referidas a fin de deslindar responsabilidades, y que los culpables sean procesados y sentenciados.
La salida inmediata del gobernador del estado de Oaxaca, ULISES RUIZ ORTIZ cuyo autoritarismo ha sido el origen del conflicto y su permanencia es la causa de la salida represiva y violenta al conflicto que se está implementando.
LA SALIDA INMEDIATA DE LA PFP DE LA CIUDAD DE OAXACA Y DEL ESTADO DE OAXACA
Que el Congreso de la Unión en comisiones unidas de diputados y senadores, procedan a enviar una comisión de investigación y se proceda de inmediato tomar las acciones pertinentes para que en el estado de Nayarit se de constancia de la grave situación en que se encuentran los 141 presos de conciencia del estado de Oaxaca.
En la Ciudad de Tepic Nayarit a los 29 dias del mes de Noviembre del año 2006.
